Don’t ever let them see you with a phone in hand. Use a mount. Touch it when it is mounted.
Just don’t. And don’t moan about it. Not a big fucking ask.
Besides modern CarPlay shit can make using your phone as hands free as possible

I purchased a small pouch lined with copper that acts like a faraday cage for both of my family members so they wouldn’t accidentally touch their phones while driving.

I got pinched for this very thing in HB earlier this year. Was trying to glance at a text from my ATF as I approached her place about where to park when I got there.
In my case a motorcycle cop was lane splitting and looked in my window as he rode between lanes. I had the phone in my lap, but he saw me touching it so I was toast.
It sucked

There was a video of a guy driving to school and eating a bagel sandwich and a cop pulled him over and was adamant that he was on his phone even though the driver had it all on his dash cam. Stupid that cops will write you tickets without any proof.

Does this law apply to self driving cars?
Apparently, the PD needs more money to fund who knows what? Next thing you know they will want to ticket you for eating a bagel 🥯.

I got a ticket for this 8 years ago. Cop was behind me and I was at a red light texting. Light turned green and I put my phone down and he pulled me over immediately. This was before I had a dash cam so I didn't want to fight it but man I should have
Either way I've been cautious ever since then. I just use apple car play/Siri to text because it's not worth it

I've had two tickets for this, but it has been a few years. Both times I was stopped at a red light, and both times a motor cop as he made his way to the front looking in each window as he passed
I'm a lot more observant now, but I haven't stopped doing it, but I do it it less often.
I see people every day with the phone up to their ear, and that really is too obvious, and with Bluetooth, kind of a dumb thing to do

This type of ticket was never a point before, just a fine. But a couple years ago that changed. Now the first time is not a point but subsequent tickets are a point, (you can request traffic school once every 18 months to avoid the point)

Stay off your phone. Cops are sneaky. Use hands frees or Apple car play. But that’s an easy ticket to fight, use the ticket clinic. Pay the extra money and fight it, don’t pay the fine. It will show up as a point on your DMV and Insurance. It will get more expensive and potential for it to show up on background checks.

there's actually a case where the guy was using the phone to check directions and the case was dismissed. You can look it up.

Then there was the case of the lady who got ticketed for holding the cell phone in her right hand. Difficulty: she did not have a right hand. Case dismissed.

While I did agree with the rule at one time because I did see many drivers on their cells texting while driving, not at a stop...freaking driving, it's hypocritical and will tell why in a few. Before I do, I will plead guilty to having done so myself. Many years ago before this 23123.5 vehicle code came out, I did almost rear end a car because I was trying to answer a call on my cell in my hand, so lesson learned.
Anyways, here is why I think this code is hypocritical:
A few weeks ago I was driving to get home just a few blocks from where I live and get a call around 6:50pm so I pull over to answer it. I find a spot and thought ok cool, safe. The lane I pulled into turned out to be a bus lane only at certain hours of the day. I did not see or read the sign that said it was a bus lane only (no parking from 4pm-7pm M-F). Apparently, buses have cameras now
where they take pictures as they drive and spot anyone that is parked in those designated time frames. My issue is that the ticket I got taken by a camera on the bus was take at 6:54.22pm, roughly 5.5 minutes before 7pm. I also did see a few cars parked in between me before I parked.
So I went to one of their local parking violation bureau centers to contest it and that is when I found out from the personnel who attended me, told me that the picture on the ticket was taken from the bus and said that every car parked on that side of the street was issued a ticket. I tried to explain to her that I thought anytime after 6pm I could park but it's pointless talking to them as everything you try to explain to them, goes in one ear and out the other. She told me that this law had been in placed since last year...crap...nobody keeps up with these codes.
If the parking violations bureau does not want people to be on their phone while driving then why punish them when they pull over. I did file for a review and waiting for my results next week.
I did not know about this new code and if I had known I would have referenced it in my statement.
